These terms and conditions apply to the viewing, purchasing, and sale of products through Pressholic, www.pressholic.com (the “site”), and PRESSHOLIC LTD. You agree to accept and be bound by these terms and conditions when you view this site, place an order or make a purchase.

PLEASE READ THESE CUSTOMER TERMS AND CONDITIONS CAREFULLY

This is a contract between you the “Customer” and us “Pressholic”. This agreement outlines the services you will receive from us, how we will work together, and other aspects of our business relationship. As used in this Privacy Policy, “Pressholic”, “company”, “us”, and “we” refer to PRESSHOLIC LTD incorporated under the jurisdiction of Companies House, gov.uk; Company Number 14506201. “Websites” refer to Pressholic’s websites (including www.pressholic.com, www.pressholic.co.uk, and any successor URLS, mobile or localized versions, related domains and subdomains), and products/packaging/goods/boxes/services refer to Pressholic’s products, applications and services, in whatever format they may be offered now or in the future.

TERMS OF SERVICE

By agreeing to these terms of service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and that you have given us your consent to allow any of your minor dependents to use this site. You may not use our products or services for any illegal or unauthorized purpose nor may you, in the use of the service, violate any laws, rules or regulations in your jurisdiction (including but not limited to copyright laws). In the event of a breach or violation of any of the terms, your use will be terminated immediately. Your use of our website constitutes agreement to the following terms and conditions. With or without prior notice, Pressholic reserves the right to amend these terms and conditions at any time. We encourage you to read this page regularly.

COPYRIGHT NOTICE

By using our website, you understand and acknowledge that all contents of this website, including text, data, software, photographs, graphics, images, illustrations, maps, designs, icons, and other materials, collectively known as “our website contents”, are the property of Pressholic and third-party providers. Content on our website may not be copied, modified, stored, republished, transmitted or otherwise distributed without our written permission

USER CONDUCT ON OUR WEBSITE

The content you send, upload, post or otherwise distribute or transmit to or via our website is solely your responsibility. You agree that any such material that you submit, upload, post or otherwise transmit to or via our website or is used in connection or combination with our website contents will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party unless you have obtained the appropriate authorizations from the respective owners for such use. The user agrees and warrants that they will not send, upload, post, or otherwise distribute or transmit any material to or via our website that is indecent, unlawful, prevents other users from using the site, or violates the intellectual property rights or other proprietary rights of Pressholic or any third party. Our website does not control the content posted by users or customers, and we cannot guarantee its accuracy, integrity, or quality. Under no circumstances will we be liable to you in any way for any content you may be exposed to that you may find offensive, indecent or objectionable. You acknowledge that Pressholic and its authorized designers shall have the right, but not the obligation, in their sole discretion to remove any content that violates the terms of service or may otherwise be objectionable. We may preserve content and may also disclose content if required to do so by law or in the case that such disclosure is necessary to:

(a) comply with legal process;
(b) enforce the terms of service;
(c) respond to claims that the content violates the rights of third-parties; or
(d) protect the rights, property, or personal safety of our website, its users and the public.

It is your responsibility to provide correct and promptly updated information for processing your orders and requests. We do not allow robots or other automated means to access or use our website. Fraudulent use of our website that violates these terms of service will be prosecuted. The use of our website and the placing of an order on our website constitute your warrant that you have the right, authority, and permission to place the order, and that Pressholic can produce the products on your behalf. By using and placing an order on our website, you agree and warrant that you are of sufficient legal age to create binding legal obligations for any liability you may incur. You agree that you will be responsible and liable for all orders and requests submitted or other actions that are taken through your registered account, email, telephonic calls, or in person. When you, or someone to whom you have given access, places orders using your name, email, text, and associated phone number, you grant us the unrestricted royalty free and non-exclusive license to use, reproduce, sublicense, modify, adapt, publish, display and create derivative works from the content on the website and on the printed product for the purposes of storing designs or processing print orders.

Access to certain portions of our website requires users to register their emails and names along with creation of a password for future access to the password protected area of our website. We reserve the right to request additional personal and business information before we register your account. Keeping your password confidential is your sole responsibility, and it must not be disclosed to anyone else. In the event that an unauthorized user gains access to the password-protected area of the site as a result of your acts or omissions, you agree that you shall be liable for any such unauthorized use. When you use our website, you consent to the collection and use of your information as described in the Pressholic Privacy Policy. You agree that you have read and understood our Privacy Policy, and your personal and business information will be collected and used as described in our Privacy Policy.

WARRANTIES, LIMITATION OF LIABILITY, INDEMNITY

You agree to defend, indemnify and hold harmless Pressholic including its members, directors, employees, representatives, vendors, suppliers, affiliates and subcontractors from and against any and all claims, damages, in the event that a charge, claim or demand, or arbitration, action or proceeding (collectively, a “claim”) is made or commenced against us, based upon, relating to or arising from the alleged wrongful acts of the customers, or alleging that the printing performed or product produced by us and ordered by the customer:
(a.) Infringes any copyright, patent or other proprietary right of any person; or
(b.) Contains matter that is libelous, slanderous, defamatory, scandalous or obscene; and
(c) are the results of unauthorized access to any password-protected area of our website.

You shall indemnify and hold us harmless from and against any loss, damages, cost and expense arising from or related to the claim including without limitation;
(1.) Defending us against any such claim
(2.) Paying any judgment or award; and
(3.) Reimbursing us for any legal fees and expenses it reasonably incurs in responding.

Under no circumstances will Pressholic including its members, directors, employees, representatives, vendors, suppliers, affiliates and subcontractors be liable for any injury, death, loss, claim, damage, act of god, accident, delay, or any special, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arise out of or are in any way connected with any use of our website or with any delay or inability to use our website, or for any information, software, data, products or services obtained through our website, even if a party has been advised of the possibility of such damages. In no event shall our total liability to you for all damages, losses and causes of action including but not limited to negligence, arising from this agreement or your use of our website exceed the amount paid by you to Pressholic for the order or request. We do not guarantee, represent, or warrant that your use of the service will be uninterrupted, timely, secure, or error-free. In no case do we guarantee that the results obtained by using the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

Production and Printing turnaround times begin once your artwork/files have been uploaded, reviewed and accepted by our Prepress department, you have approved the press-ready and final specifications proof (whether it be an electronic file or hard copy) and a full payment including shipping and handling fees has been made. You can select the production speed during the order placement process on our website or through direct payment, which indicates the number of business days required to print and package your order for shipment. We must receive your approval of the proof within 24 hours. We make all efforts to print and ship your orders in a timely manner. Pressholic shall not be liable for any consequential or other damages resulting from any delays in shipping or delivery. In the event of delays in shipment caused by inclement weather, delays with shipping companies, customs issues or anything else beyond our control, you agree not to hold Pressholic responsible. In case of delay due to technical problems due to equipment failure during the printing process, expedited charges will be refunded. Orders cannot be cancelled due to delays in the printing process.

You agree to pay all customs duties and fees for goods shipped to their respective locations. The responsibility for clearing customs for shipments delivered outside of the United States lies with the customer. In some cases, Pressholic offers free 5- 10 business days ground shipping to one location per order within the USA, UK, and Canada with no quantity or weight limit. Extra shipping charges will apply to additional destinations. Shipping and delivery transit times cannot be guaranteed by us, and we are not responsible for any delays, loss, damage or theft to the printed products during the shipping and delivery process. Any damage that occurs during shipping will not be the responsibility of Pressholic. Lost or damaged shipment claims can be filed after 20 days from the package shipment date.

You will need to contact us at support@pressholic.com within 3 business days if the delivered product does not meet your order specifications because of the custom nature of our printing products and other services. We cannot issue a refund or credit; however, we will reprint your original order if we made an error or found it defective. The determination of defects is at the discretion of our management. To receive a reprint of your original order, you must submit digital photos/proofs documenting the product defect and return, at your own expense, the full quantity of the original order to us within 2 business days of taking the original order delivery. The expedited order processing fees are non-refundable. The disputed products are not intended for your use. If any work has been done by Pressholic upon order acceptance, including, but not limited to: dieline design, artwork design, artwork modifications, structural design, or sample creation, a refund can be issued after deducting the cost of the work done by Pressholic and deducting the transaction fees incurred from the original order. If no work has been done by Pressholic upon order acceptance, refunds can be given after deducting the cost of transaction fees incurred from the original order. No refunds will be given if we have not received any form of written/telephonic communication from you after 20 days from our last email or written communication to you.

The ordered product(s) cannot be replaced, refunded, or returned after 30 days of arrival. Should we, in our sole discretion, decide to replace any products or to refund or credit to you any amounts paid for an order, such replacement, refund, or credit shall constitute our entire, sole, and exclusive liability with respect to that order, and your sole and exclusive remedy. If you dispute any charge that has been made to your credit/debit card, you acknowledge that Pressholic may authorize a third-party vendor to handle and seek to resolve such dispute on Pressholic’s behalf, which may include providing such vendor with the following information: your name, address, email address, phone number, and the first 6 and last 4 digits of your credit/debit card number. You consent that Pressholic may provide such information to the third-party vendor and that the third-party vendor may further disclose that information to your credit/debit card company, the bank issuing the credit/debit card and Pressholic merchant processing company for the purpose of settling the dispute. Pressholic will endeavor to have the third-party vendor agree to maintain the confidentiality of such information. If you dispute valid charges made by Pressholic to your credit/debit card and your dispute is subsequently found to be fraudulent, you agree to reimburse Pressholic for Pressholic’s expenses (including bank’s and attorney’s fees) incurred in connection with resolving the dispute.

All prices provided by our customer service team will be in United States Dollars (USD). Payment for orders will be made in U.S. dollars ($). Due to the custom nature of printing products and other services we provide, we will not start working on your orders for printing jobs or other services until a full payment including all charges, taxes, shipping and handling fees is paid by credit/ debit card or paid by the user of our website with an authorized payment method. As a part of order placement, we require customers of our website to sign off on/accept proof of the electronic file of the printing products or other services they order. When the proof has been approved by the customer, the printing job is sent to the press. Once a print job has been approved by the customer and sent to press on or via our website, no changes are allowed to the artwork files, job specifications, or printing turnaround time. If you wish to withdraw your order after approval of the proof, you have only 6 hours to do so. Order cancellations will carry a minimal charge before the cancellation is processed. You may also cancel orders after accepting them for printing within 6 hours. A 15% cancellation fee will be charged to cover work done by our pre-press department and financial costs incurred during cancellation. Orders that are cancelled beyond the 6-hour deadline cannot be guaranteed. If an order is canceled after the 12-hour time limit, 25% of the total order amount will be charged to cover printing costs.

BILLING INFORMATION

We may, in our sole discretion, limit or cancel quantities purchased per individual, per business, or per order. These restrictions may apply to orders placed by or under the same payment method, as well as orders shipped to the same billing address and/or shipping address. When we make a change to or cancel an order, we may attempt to contact the email address and/or billing address/phone number you provided at the time the order was placed. It is your responsibility to provide Pressholic with updated, accurate and complete information about your purchase and any other relevant information in connection with your purchase. In order for us to complete your transactions and contact you as needed, you agree to promptly update the information about you, including your email address, credit/debit card numbers and expiration dates.

DESIGN ORDERS

Any order placed for design services will not be refunded or credited by Pressholic. Once a design order is placed, it is non-refundable and non-cancellable.

ARTWORK/DESIGN FILES

Using the artwork and files provided by website users and customers, our graphic designers and experts prepare electronic proofs. We require that your submitted artwork/files must be at least 300 DPI (Dots Per Inch) resolution at the final size and in CMYK format. If your files are not submitted at 300 DPI at the final size and in CMYK format, we will not be responsible for blurred, distorted or pixelated printing or color changes associated with conversion to CMYK. You are responsible for the accuracy of your print-ready artwork/files including any issues as to the orientation or alignment of the pages of your provided documents. In spite of our best efforts to prevent the loss of your artwork/design files, we cannot be held liable if they are damaged or lost. If you upload artwork or design files to our website, you acknowledge that you are either the lawful owner of the materials you upload or you have already obtained appropriate rights to use those materials. We reserve the right to refuse an order if we believe that it may be illegal in nature, or if it may infringe on other people’s rights. In the event that material is processed and printed on your behalf and in accordance with your instructions, you accept full legal liability for the content of such material. We reserve the right to refuse an order without disclosing a reason. Please note, we do not accept offensive, indecent or improper material for printing.

PROOFS AND COLOR ACCURACY

Customers and users are required to approve proofs of electronic files of the printing products or other services they order from our website. Your approval of the proofs is required before we send the job to press. You are responsible for double-checking the proof files. Any delays in the order caused by a customer’s failure to approve the proof are not our responsibility. The turnaround times listed on our website begin after your approval of the proof. Please review your proof thoroughly before approving it. Make sure it matches the original file for possible errors in layout, copy, spacing, punctuation, image placement and proportion, bleeds, crops, and final text. Electronic proofs do not show transparency, overprint issues or color changes from RGB to Pantone or CMYK. Please note, the application of add-ons like spot UV coating, holography, foil stamping, soft touch, embossing/debossing, glossing, or matte/gloss lamination may affect or change the appearance of the printed colors. We are not liable for the final color appearance of a laminated or add-on product(s).

It is entirely the customer’s responsibility to ensure that the final approved proof is accurate. Although we will match color and density as closely as possible from print-ready files, we cannot guarantee that they will match exactly. Because of inherent limitations of the printing process, as well as neighboring image ink requirements, the accuracy of color reproduction is not guaranteed. Purchasing from us indicates your agreement with this limitation. While we will do our part to match the gradient density of each color, we do not accept responsibility for color variations between submitted files and the final printed piece or the actual artwork or product they represent. Under no circumstances will a reprint be honored for color variations that have occurred during the printing process. We are not liable for color matching or ink density on screen proofs that you approve. We will guarantee color accuracy and match if you order a hard copy (custom-made physical samples) proof from us. You will be charged an additional fee if you want a hard copy proof.

NO LIABILITY FOR ERRORS

Pressholic is not responsible for errors in a final product caused by any of the following:
(a.) Misspelling and Grammar, Damaged Fonts
(b.) Graphics, Bleeds, Punctuation,
(c.) Wrong, Incorrect or Missing Folds, Die lines, Crop Marks, Transparency, Cracks on Folds
(d.) Overprint,
(e.) Finished Product Size.

GANG PRINTING

We don’t use gang printing for most of our printing products at Pressholic. Sometimes, and depending on the requirements of each individual website user and customer, we may select a printing method that is best suited for a particular print item.

OVERRUNS/UNDERRUNS

We usually deliver the exact amount of goods ordered plus a small amount extra. Additional units are not subject to any additional charges. If there is an underrun, we will bill for the actual quantity produced. We follow the generally accepted trade practice of delivering plus or minus 6% of the ordered quantity.

PRODUCTION, SHIPPING, AND DELIVERY LEADTIME

After your artwork/files have been uploaded, reviewed and accepted by our prepress department, the press-ready proof has been approved (whether it is an electronic file or a hard copy) and a full payment (including shipping and handling fees) has been made, production speed and printing turnaround time begin. During the order placement process with Pressholic, you can select production speed, which indicates the number of business days required to print and prepare your order for shipment. It is imperative that you approve the proof as soon as possible. We do our best to print and ship orders as quickly as possible. Pressholic shall not be held responsible for any consequential or damages resulting from any shipping or delivery delays. We are not responsible for delays in shipments caused by bad weather, shipping company delays, customs issues, or any other circumstance beyond our direct control. If there is a delay due to equipment failure during the printing process, expedited charges will be refunded. Delays in the printing process cannot lead to cancellation of orders. 

You agree to pay all customs duties and fees on goods shipped to their respective destinations. Customers are responsible for making arrangements for clearance of customs for shipments shipped outside the United States, Canada, and the United Kingdom. Pressholic offers free 6 business day ground shipping for any one location within the United States, Canada (custom duty is paid by the customer) and the United Kingdom without a limit on quantity or weight. There will be an additional charge for shipping to additional destinations. We do not guarantee shipping and delivery transit times and are not responsible for any delays, losses, damage or theft during shipping and delivery. Any damage that occurs during shipping is not the responsibility of Pressholic. In the event that you provide us with an incorrect shipment delivery address or fail to provide us with the complete delivery address, we will charge you additional shipping and handling fees for re-shipping.

THIRD-PARTY LINKS

There may be third-party materials included in certain content, products and services available through our service. Links on this site may direct you to third-party websites that are not affiliated with us. Third-party materials and websites are not under our control, and we cannot evaluate their content or accuracy. We do not warrant or assume any responsibility for third-party materials, products, or services. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Any complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.

TERMINATION

The rights, obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of our relationship or any transactions completed on our website for all purposes. These terms of service are effective unless and until terminated by either you or us. The terms of service can be terminated at any time by notifying us that you do not wish to continue using our services or ceasing to use our website. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these terms of service, we also may terminate our relationship at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our service (or any part thereof).

GOVERNING LAW

These terms of service and any separate agreements whereby we provide you with the service or any products or services shall be governed by and construed in accordance with the laws of the United States, United Kingdom, Canada, Pakistan, and China special administrative region, without regard to conflicts of law principles.

AMENDMENTS TO OUR WEBSITE OR TERMS AND CONDITIONS

Whether with or without notice to customers and users of our website, we reserve the right to make any modifications to our Terms and Conditions to our website. The updated terms of service will be posted on our website and will take effect immediately following the changes to our website. As soon as we post changes to our website, your continued use of it will constitute your acceptance of those changes.

THE ENTIRE AGREEMENT

These terms and conditions constitute the entire agreement and understanding between you, the customer, and Pressholic concerning the subject matter hereof and supersede all prior agreements and understandings of the parties with respect thereto, including any oral statements made by Pressholic representatives or any alternate terms supplied by you to Pressholic unless otherwise agreed to by Pressholic in writing. Any conflict or inconsistency between these terms and conditions and something within or associated with the site will be resolved according to these terms and conditions.
